1. ABOUT
Waqas Shah (the “Company”) is a digital-first and appointment-based brand focusing on bridal, formal, and semi-formal collections that are made-to-measure and made-to-order. We aim to provide exceptional quality and treat every customer with care and professionalism.

2. APPLICATION OF TERMS
All orders placed with the Company (online or otherwise) are subject to these Terms. By placing an order, you agree to these Terms and waive any conflicting personal terms unless agreed in writing.

3. DEFINITIONS
- Alterations: Modifications made after completion at additional cost
- Body Measurements: Exact measurements without margin
- Garment Measurements: Final stitched size including margin
- Completion Day: Date the dress is finished (not dispatch date)
- Customer: Person placing the order
- RTW: Ready-to-Wear (standard size outfits)
- Order Confirmation: Official confirmation via invoice/payment/communication
- Purchase Price: Total cost excluding taxes/shipping
- Intellectual Property: All designs, logos, and brand assets

4. OFFERS & PRICING
All price quotations are indicative and typically valid for 7 days unless stated otherwise.
Prices may change due to:
- Raw material cost changes
- Exchange rate fluctuations
- Production cost increases
All offers are subject to availability and approval.

5. ORDER ACCEPTANCE
Orders are confirmed upon:
- Payment received
- Invoice issued
- Confirmation via WhatsApp/email
Payment Structure:
- Bridal Orders: 50% advance
- Formal/Festive Orders: 100% advance
The Company reserves the right to refuse or cancel any order.

5A. COMPANY’S RIGHT TO CANCEL
The Company may cancel any order at its discretion.
Refunds (if applicable) will follow Clause 17B.
Liability is limited strictly to the amount paid.

6. MEASUREMENTS
The Customer is responsible for providing accurate body measurements.
- No margin or ease should be added
- Incorrect measurements = Company not liable
Alterations:
- Charged separately
- Subject to approval
The Company may request verification (photos/video call).

7. PAYMENT TERMS
- Deposits become non-refundable after 3 days
- Full payment required before delivery
- Orders unpaid after 14 days may be cancelled
Payment Fees:
- Card payments may include 7% processing fee
- Refunds will deduct transaction fees

8. FAST TRACK ORDERS
- Require 100% advance
- Non-refundable from day 1
- Proof of event date required

9. NO RETURN / NO EXCHANGE
All products are:
- Made-to-order
- Non-refundable
- Non-exchangeable

10. READY-TO-WEAR (RTW)
- Standard sizes only
- No refund/exchange
- Minor variations may occur
Defects must be reported within 24 hours.

11. TAXES & DUTIES
- Prices exclude customs duties
- International customers must pay applicable taxes

12. RETENTION OF TITLE
Products remain Company property until full payment.
Uncollected orders:
- 14 days (normal)
- 5 days (fast track)
May be resold without liability.

13. DELIVERY
Delivery timelines are estimates only.
Delays may occur due to:
- Production
- Customer delays
- External factors
No compensation for delays.

14. FORCE MAJEURE
The Company is not liable for delays caused by events beyond control (e.g. natural disasters, political issues, pandemics, etc.).

15. SHIPPING RISK
Risk transfers after dispatch.
Courier issues are not the Company’s responsibility.
Customers are advised to arrange shipping insurance.

16. PRODUCT ACCEPTANCE
Products must be inspected within 5 business days.
If defect is verified:
- Repair OR
- Store credit OR
- Partial remake
No cash refunds.

17. CHARGEBACKS
Chargebacks are strictly prohibited.
If initiated:
- Legal action may be taken
- Loss recovery + legal fees

17A. REFUND POLICY
No monetary refunds.
Only store credit (if applicable).

17B. REFUND PROCESSING
- 10–14 business days processing
- Payment gateway fees will be deducted

18. CANCELLATION
Allowed within 3 days only.
After 3 days:
- No cancellation
Deductions may apply.

19. DISSOLUTION
Failure to meet obligations may result in termination and recovery of losses.

20. PRODUCT VARIATIONS
Minor variations in:
- Color
- Design
- Handcrafted finish
are not defects.

21. SAMPLE SALE
- Non-refundable
- May have minor wear

22. CONFIDENTIALITY
All designs and materials are Company property and confidential.

23. INTELLECTUAL PROPERTY
All content belongs to Waqas Shah.
Unauthorized use is prohibited.

24. ANTI-FRAUD POLICY
The Company may:
- Verify identity/payment
- Cancel suspicious orders

25. LIMITATION OF LIABILITY
Liability is limited to amount paid only.
No indirect damages.

26. NOTICES
Communication may be via:
- Email
- WhatsApp
- Official channels

27. SEVERABILITY
Invalid clauses do not affect remaining Terms.

28. DISPUTE RESOLUTION
Disputes will be resolved via:
Negotiation → Mediation → Arbitration

29. GOVERNING LAW
These Terms are governed by the laws of Pakistan.
